This Article analyzes the composition of the board of directors as a vehicle for state intervention in corporate governance. Such intervention is ubiquitous and often motivated by goals that stray from shareholder wealth maximization, or corporate governance more generally, to promote other national interests such as diversity. Regulating board composition thus is merely the continuation of politics by other means. After briefly discussing direct state ownership in business firms as a way to advance policy goals, the Article explicates the tensions (...) between boards’ dual responsibilities of monitoring and strategy-setting. These oftentimes conflicting missions curb the law’s ability to guide board members’ conduct through the conventional legal duties of loyalty and care or other injunctions. Although the two roles also may entail conflicting implications for board composition, regulation of board composition nonetheless may prove a superior means for promoting policy goals, especially with regard to the objective of the corporation. Composition regulation harnesses board members’ personal attributes — specifically, their values — to facilitate the attainment of these goals. Instead of telling board members what to do, the state may fare better by regulating who they are. (shrink)

This article tells the story of an Israeli regulatory program aimed at luring back home Israeli companies listed only on U.S. stock markets, to facilitate dual listing of their stocks on the Tel Aviv Stock Exchange. Beyond documenting a piece of Israeli political economy, this article provides several lessons of general relevance to small or emerging markets as well as to large ones. In this story, the regulator of the small market finds itself a regulatory price-taker. In a mirror image, (...) the U.S. market emerges as a global regulatory price-setter. This regulatory externality, or regulatory arbitrage, is disturbing because the standard with which Israeli regulation had to align is the watered-down version for non-U.S. issuers. Indeed, any effort to require an iota of additional disclosure beyond the American foreign issuer regime has failed due to vehement objections from the Tel Aviv Stock Exchange and business interest groups. The role of the stock exchange as regulator and the interplay between corporate law and securities regulation are also discussed in this context. This article thus casts some doubt on the desirability of piggybacking on foreign markets. Sometimes, it turns out, piggybacking can be a ride to the bottom. (shrink)

Over recent years, the research community has been increasingly using preprint servers to share manuscripts that are not yet peer-reviewed. Even if it enables quick dissemination of research findings, this practice raises several challenges in publication ethics and integrity. In particular, preprints have become an important source of information for stakeholders interested in COVID19 research developments, including traditional media, social media, and policy makers. Despite caveats about their nature, many users can still confuse pre-prints with peer-reviewed manuscripts. If unconfirmed but (...) already widely shared first-draft results later prove wrong or misinterpreted, it can be very difficult to “unlearn” what we thought was true. Complexity further increases if unconfirmed findings have been used to inform guidelines. To help achieve a balance between early access to research findings and its negative consequences, we formulated five recommendations: (a) consensus should be sought on a term clearer than ‘pre-print’, such as ‘Unrefereed manuscript’, “Manuscript awaiting peer review” or ‘’Non-reviewed manuscript”; (b) Caveats about unrefereed manuscripts should be prominent on their first page, and each page should include a red watermark stating ‘Caution—Not Peer Reviewed’; (c) pre-print authors should certify that their manuscript will be submitted to a peer-review journal, and should regularly update the manuscript status; (d) high level consultations should be convened, to formulate clear principles and policies for the publication and dissemination of non-peer reviewed research results; (e) in the longer term, an international initiative to certify servers that comply with good practices could be envisaged. This article examined the recent emergence of the national and international issue of religious polarisation and identity, which affects some groups’ populism and fanaticism. Regarding social phenomena, religion and identity are intertwined like the two sides of a coin. This discourse has an impact how to interpret diversity on religious issues that are caused by political influences. Given the polarisation of identity politics and religion, the national and state campaign slogan ‘unity in diversity’ is merely wishful thinking. The polarisation of (...) identity and religion is heavily implicated in the Indonesia–Philippines border case; consequently, in some instances, the ‘seeds’ of these cases are discovered, eventually resulting in group fanaticism. This article employed the historical way of writing while also taking a social science angle that interacts with the research being done. For some communities, religion and identity may take on symbolic meaning, affecting how well they adapt and are accepted. However, the qualities of a community group or region are also shaped by historical events. According to the study’s findings, religion and ethnic identity have played important roles in long-standing historical processes and impacted them. This study is anticipated to ‘suppress’ the problem of political division involving religion and identity because the identification of ‘border’ communities depends not only on entity and identity issues but also on the community’s culture.Contribution: The contribution in this study is that it has an impact on religious issues and cultural identity relations perspectives. Background Moral distress is a common challenge among professional nurses when caring for their patients, especially when they need to make rapid decisions. Therefore, leaving moral distress unconsidered may jeopardize patient quality of care, safety, and satisfaction. Aim To estimate moral distress among nurses. Methods This systematic review and meta-analysis conducted systematic search in Scopus, PubMed, ProQuest, ISI Web of Knowledge, and PsycInfo up to end of February 2022. Methodological quality of included studies was assessed using the Newcastle Ottawa checklist. (...) Data from included studies were pooled by meta-analysis with random effect model in STATA software version 14. The selected key measure was mean score of moral distress total score with its’ 95% Confidence Interval was reported. Subgroup analyses and meta-regressions were conducted to identify possible sources of heterogeneity and potentially influencing variables on moral distress. Funnel plots and Begg’s Tests were used to assess publication bias. The Jackknife method was used for sensitivity analysis. Ethical consideration The protocol of this project was registered in the PROSPERO database under decree code of CRD42021267773. Results Eighty-six manuscripts with 19,537 participants from 21 countries were included. The pooled estimated mean score of moral distress was 2.55 on a 0–10 scale [95% Confidence Interval: 2.27–2.84, I2: 98.4%, Tau2:0.94]. Publication bias and small study effect was ruled out. Moral distress significantly decreased in the COVID-19 pandemic versus before. Nurses working in developing countries experienced higher level of moral distress compared to their counterparts in developed countries. Nurses' workplace (e.g., hospital ward) was not linked to severity of moral disturbance. Conclusion The results of the study showed a low level of pooled estimated score for moral distress. Although the score of moral distress was not high, nurses working in developing countries reported higher levels of moral distress than those working in developed countries. Therefore, it is necessary that future studies focus on creating a supportive environment in hospitals and medical centers for nurses to reduce moral distress and improve healthcare. (shrink)

Theories of decision-making and its neural substrates have long assumed the existence of two distinct and competing valuation systems, variously described as goal-directed vs. habitual, or, more recently and based on statistical arguments, as model-free vs. model-based reinforcement-learning. Though both have been shown to control choices, the cognitive abilities associated with these systems are under ongoing investigation. Here we examine the link to cognitive abilities, and find that individual differences in processing speed covary with a shift from model-free to model-based (...) choice control in the presence of above-average working memory function. This suggests shared cognitive and neural processes; provides a bridge between literatures on intelligence and valuation; and may guide the development of process models of different valuation components. Furthermore, it provides a rationale for individual differences in the tendency to deploy valuation systems, which may be important for understanding the manifold neuropsychiatric diseases associated with malfunctions of valuation. Background:Ethical conflict is a barrier to decision-making process and is a problem derived from ethical responsibilities that nurses assume with care. Intensive care unit nurses are potentially exposed to this phenomenon. A deep study of the phenomenon can help prevent and treat it.Objectives:This study was aimed at determining the frequency, degree, level of exposure, and type of ethical conflict among nurses working in the intensive care units.Research design:This was a descriptive cross-sectional research.Participants and research context:In total, 382 nurses working in (...) the intensive care units in Iranian hospitals were selected using the random sampling method. Data were collected using the Ethical Conflict in Nursing Questionnaire-Critical Care Version (Persian version).Ethical considerations:This study was approved by the Medical Research Ethics Committee. Ethical considerations such as completing the informed consent form, ensuring confidentiality of information, and voluntary participation were observed.Findings:The results showed that the average level of exposure to ethical conflict was 164.39 ± 79.06. The most frequent conflict was related to “using resources despite believing in its futility,” with the frequency of at least once a week or a month (68.6%, n = 262). The most conflictive situation was violation of privacy (76.9%, n = 294). However, the level of exposure to ethical conflict according to the theoretical model followed was the situation of “working with incompetent staff.” The most frequently observed type of conflict was moral dilemma.Conclusion:The moderate level of exposure to ethical conflict was consistent with the results of previous studies. However, the frequency, degree, and type of ethical conflict were different compared to the results of other studies. Recognizing ethical conflict among intensive care unit nurses can be useful as it allows to consolidate those measures that favor low levels of ethical conflict, design appropriate strategies to prevent ethical conflicts, and improve the nursing work environment. The Quran makes repentance an important element of piety and exhorts believers to repent of their sins. Numerous hadith also emphasize its importance, along with God’s merciful forgiveness of the repentant sinner. In his K. al-Tawwābīn, the Hanbali scholar Ibn Qudāma al-Maqdisī draws on a wide range of akhbār to present examples of repentance of angels, prophets, Companions of Muḥammad, pious mystics, and others, including non-Muslims. Ibn Qudāma’s treatise stands out for his frequent citation of accounts maligned by other scholars (...) as isrāʾīliyyāt. In addition, his willingness to highlight the sins of prophets and the Prophet’s Companions, while in line with other Hanbalis, challenges common notions of prophetic impeccability and the ethical qualities of the ṣaḥāba. In this article we argue that Ibn Qudāma is willing to challenge these notions because of his vision for the construction of the pious self. He sees human initiative in overcoming the self’s natural inclination to sinfulness as a necessary step toward spiritual excellence. In this regard his spiritual vision is shaped by certain Sufi notions. While divine grace still plays a role in the working of repentance, it does not eliminate the need for human initiative. This led Ibn Qudāma to construct a mythical past in which many of the great spiritual figures were involved with a spiritual struggle with their own immoral or impious instincts. (shrink)

To maintain the competitive edge and evaluating the needs of the quality app is in the mobile application market. The user’s feedback on these applications plays an essential role in the mobile application development industry. The rapid growth of web technology gave people an opportunity to interact and express their review, rate and share their feedback about applications. In this paper we have scrapped 506259 of user reviews and applications rate from Google Play Store from 14 different categories. The statistical (...) information was measured in the results using different of common machine learning algorithms such as the Logistic Regression, Random Forest Classifier, and Multinomial Naïve Bayes. Different parameters including the accuracy, precision, recall, and F1 score were used to evaluate Bigram, Trigram, and N-gram, and the statistical result of these algorithms was compared. The analysis of each algorithm, one by one, is performed, and the result has been evaluated. It is concluded that logistic regression is the best algorithm for review analysis of the Google Play Store applications. The results have been checked scientifically, and it is found that the accuracy of the logistic regression algorithm for analyzing different reviews based on three classes, i.e., positive, negative, and neutral. Philosophers have long debated whether, if determinism is true, we should hold people morally responsible for their actions since in a deterministic universe, people are arguably not the ultimate source of their actions nor could they have done otherwise if initial conditions and the laws of nature are held fixed. To reveal how non-philosophers ordinarily reason about the conditions for free will, we conducted a cross-cultural and cross-linguistic survey (N = 5,268) spanning twenty countries and sixteen languages. Overall, participants tended (...) to ascribe moral responsibility whether the perpetrator lacked sourcehood or alternate possibilities. However, for American, European, and Middle Eastern participants, being the ultimate source of one’s actions promoted perceptions of free will and control as well as ascriptions of blame and punishment. By contrast, being the source of one’s actions was not particularly salient to Asian participants. Finally, across cultures, participants exhibiting greater cognitive reflection were more likely to view free will as incompatible with causal determinism. We discuss these findings in light of documented cultural differences in the tendency toward dispositional versus situational attributions. (shrink)

The main purpose of this study is to become acquainted with the educational institutions in Ottoman Empire during and after the 18th century. In this respect, special attention is given to which initiatives were taken in terms of education and which educational institutions were established during the aforementioned period. The need to comply with the West in terms of science, culture, reasoning, and technological advancements has led to the questioning of the current madrasah system. Upon revising the educational system of (...) the madrasah, which had difficulties in being productive and attaining to the necessities of the time, there have been initiatives primarily to establish and structure military schools. These attempts to reform education was intensively seen as from the early 18th century. The above-mentioned changes and progress have gained momentum with the Tanzimat era. It was observed that during this period, many schools were established beyond military; education levels were clarified and; females were given right to study. Similar to Tanzimat era during the first Constitutional Monarchy and Autocracy eras, positive contributions toward educational reforms were made. However, beginning from the middle of the second Constitutional Monarchy era, the economic and social complications that the state was going through had a negative impact on the educational system and the practicality of the educational institutions.Summary: Education has been the most important factor in determining the social, economic, and cultural level of a society. The level of development, which is the determinant of the superiority of the nations to each other over the world, varies according to the importance given to education. To be a pioneer in the scientific sense, to be able to have technological opportunities, to make people live more comfortable and peaceful, to have more power in the economic field and to ensure the continuity of the nation that depending on all these, it will be possible with the understanding of education that can read the time and future well. The fact that world states are superior to each other in different periods of history is directly related to their understanding of education. It can be said that in the centuries following the beginning of the new age, especially the Western nations have taken a more positive step at this subject. The changes in both mental and action spheres such as XVI. century Renaissance movements, XVIII. century enlightenment movement and finally the industrial revolution triggered the development in the scientific and technological field. In these periods the importance given to thinking and the freedom of thought has been the main factor of the progress in the scientific field. The European nations, which went beyond their religion-based bigotry and prioritized the free and secular understanding, have become superior to other nations of the world. However, it is not quite possible to say that in the same periods the Ottoman Empire was able to adapt with the same speed to such accelerations of change and development that placed in Europe. One of the main reasons for this situation and perhaps most importantly is that the educational concept in the Ottoman Empire remained within a static structure in the last centuries. In particular, the matters such as the madrasa being away from productivity, the limitation of the understanding of the science only with religious sciences, has led to the problem of inability to adapt to the rapid transformation that in Europe. The first steps towards eliminating this weakness noticed by the state executives over time has been taken through the improvement and transformation of the Ottoman educational institutions. It is possible to say that the first attempts as to these restructures of education, which is also called as Westernization or modernization by the educational historians, has begun in the period of Sultan III. Selim. In the context of the Nizam-ı Cedid movement, a number of positive initiatives in education, such as the improvement of madrasas, the opening of military schools and translation activities, constitute the core of the changes that will take place in later periods. Immediately afterwards, in the period of II. Mahmut, making the reading and writing education compulsory, opening of Western-style junior high school, establishing medical and vocational schools that provide education at higher education level are considered as positive innovations of the period. The time interval from the proclamation of the Tanzimat edict until the First Constitutional monarchy is the period in which the institutionalization and structuring towards education in the Ottoman Empire is at the highest level. Besides many educational institutions in this process where the ministry responsible for education and training is established and the regulation containing the arrangements regarding this field is put into force, one of the most important initiatives made is laying the foundations of the Dâr al-Fünûn (Ottoman University) which is considered as the first university in this land. The fact that many educational institutions established in this period that are the roots of today's educational institutions is important in terms of demonstrating the accuracy of the initiatives within the mentioned period. In Meşrutiyet (the First Constitutional Monarchy) and the subsequent period of Mutlakiyet (Autocracy), contributions were provided on previous positive structuring. However, the social and economic problems experienced in the country since the second half of II. Meşrutiyet (the 2nd Constitutional Monarchy) have been effective in the inability of continuing innovations towards education. In this study, the educational institutions established in the Ottoman Empire before and after the Tanzimat period were discussed. The aim is not just to reveal what these schools are. It was also aimed to emphasize which areas in which schools are required to be based on which needs, which obstacles are encountered during the change of mentality in education, regulatory activities foreseen to overcome obstacles and to what extent they have been successful. In this regard, the signals of change as to the structure of educational institutions, which could be the source of most of the republic period, started from the beginning of 1700s and continued until World War II period. During this period of more than a hundred years, the political periods related to the structure and functioning of the state have also been influential in the structuring of educational institutions. In fact, the Reorganization (Tanzimat) period, which is known as ‘reform’ in the mentioned process, is considered as the stage where the change and transformation concerning education is the most. It is seen that the process of westernization still continues even though it is not with the same acceleration in the Constitutional Monarchy and Autocracy periods after the Reorganization period. When looking at the facility of educational institutions in chronological order, it is determined that there is a dominated understanding that prioritizes to train military staff in the military field and to have a competent army with the technological possibilities of the time, in other words, to create a strong defence system against the foreign powers of the country. Indeed, for the first time in order to give technical information about modern military, Hendesehane opened and started to operate in İstanbul in 1734 by Mahmut I; Mühendishâne-i Bahrî-i Hümâyûn, the school of the first military maritime was opened in 1775 in order to provide modern education; Mühendishâne-i Berrî-i Hümâyun was founded in 1795 in Istanbul, in order to train artillery and military officer (military engineer); Mekteb-i Harbiye, which was opened in 1835 to train officers, and Menşe-i Küttab-ı Askeri, which was established to train military scribes, contributed to the contemporary construction of the army. In the mentioned period, the most important change outside the military area was in the health area. In this sense, in order to meet the medical doctor needs of the army, Tıbhâne-i Amire was established in 1827. In 1867, the first civilian medical school, Mekteb-i Tıbbiye-i Mülkiye, started education and training. Another important innovation movement for education was in the field of law. In this context, the School Law was established in 1880. In order to train competent staff in administrative staff, the schools of the Mekteb-i Mülkiye, the schools of teacher, the schools that enable women to do education, the improvement of schools that train the clergy and the regulations based on this take attention as educational activities carried out in the mentioned period. Background Ethical decision‑making and behavior of nurses are major factors that can affect the quality of nursing care. Moral development of nurses to making better ethical decision-making is an essential element for managing the care process. The main aim of this study was to examine and comparison the effect of training in ethical decision-making through lectures and group discussions on nurses’ moral reasoning, moral distress and moral sensitivity. Methods In this randomized clinical trial study with a pre- and post-test design, (...) 66 nurses with moral reasoning scores lower than the average of the community were randomly assigned into three equal groups (n = 22) including two experimental groups and one control group. Ethical decision-making training to experimental groups was provided through the lectures and group discussions. While, the control group did not receive any training. Data were collected using sociodemographic questionnaire, the nursing dilemma test (NDT), the moral distress scale (MDS) and the moral sensitivity questionnaire (MSQ). Unadjusted and adjusted binary logistic regression analysis was reported using the odds ratio (OR) and 95% confidence intervals. Results Adjusted regression analysis showed that the probability of increasing the nursing principle thinking (NPT) score through discussion training was significantly higher than lecture (OR: 13.078, 95% CI: 3.238–15.954, P = 0.008), as well as lecture (OR: 14.329, 95% CI: 16.171–2.005, P < 0.001) and discussion groups compared to the control group (OR: 18.01, 95% CI: 22.15–5.834, P < 0.001). The possibility of increasing moral sensitivity score through discussion training was significantly higher than lecture (OR: 10.874, 95%CI: 6.043–12.886, P = 0.005) and control group (OR: 13.077, 95%CI: 8.454–16.774, P = 0.002). Moreover, the moral distress score was significantly reduced only in the trained group compared to the control, and no significant difference was observed between the experimental groups; lecture group vs. control group (OR: 0.105, 95% CI: 0.015–0.717, P = 0.021) and discussion group vs. control group (OR: 0.089, 95% CI: 0.015–0.547, P = 0.009). Conclusions The results of this study indicate that ethical decision-making training is effective on empowerment of ethical reasoning. Whereas the group discussion was also effective on increasing the ethical sensitivity, it is recommended the training plan provided in this study to be held as workshop for all nurses in health and treatment centers and placed in curricular plan of nursing students. We investigate computability theoretic and topological properties of spaces of orders on computable orderable groups. A left order on a group G is a linear order of the domain of G, which is left-invariant under the group operation. Right orders and bi-orders are defined similarly. In particular, we study groups for which the spaces of left orders are homeomorphic to the Cantor set, and their Turing degree spectra contain certain upper cones of degrees. Our approach unifies and extends Sikora’s [28] (...) investigation of orders on groups in topology and Solomon’s [31] investigation of these orders in computable algebra. Furthermore, we establish that a computable free group Fn of rank n>1 has a bi-order in every Turing degree. (shrink)

In general, narcotics and substance abuse in all forms can have crushing and all-encompassing effects, that is, inflict heavy blows on the (...) body, soul, mind, willpower and religion in a person and consequently destroy life in the family and society. The continuation of life as well as the stability and survival of this holy institution accordingly depends on many factors, including addiction tendency (AT) and sexual dysfunction (SD). It is also obvious that the balance and optimal use of sexual instinct on the accepted path of religion will be the key to the family health and strength. Altogether, the role of AT and SD on intention to divorce (ITD) in Indonesian Muslim couples ( n = 450) was investigated in 2022 in this study, wherein one partner had previously attended addiction treatment centres over the last 6 months. The study results ultimately demonstrated that AT could induce SD and consequently raise ITD among Muslim couples. Contribution: The study results confirmed the harmful impacts of AT on SD among Muslim couples, which could increase their ITD. In view of this, it was suggested to promote religious teachings in the family to benefit from their positive effects. (shrink)

In dem Buch ‘Rationalität in der Angewandten Ethik’, in dem sich verschiedene Autoren die Aufgabe gestellt haben, diese Umstände in das Licht der Betrachtung zu rücken, finden wir Fragen darüber, wie “Moral”, “Angewandte Ethik” und “Vernunft” (auch in der Anwendung) zu verstehen und zu vereinen sind.

In der Geschichtsschreibung der Philosophie und in der Tradition der Platon-Interpretation wird die eminente Rolle dieses Philosophen verstanden als eines der wichtigsten Phänomene einer Neuorientierung, als Ablösung von der vorsokratischen Denktradition. Diese Einschätzungen gehen wie selbstverständlich davon aus, dass sich der Innovationsschub allein aus der intellektuellen Leistung Platons erklärt, denn angeblich hatte er keine Vorbilder. Bei genauerer Betrachtung stellt sich allerdings heraus, dass Platon selbst eingebunden war in intellektuelle Strömungen mit Langzeittradition, die in die Ära der klassisch-griechischen Antike nachwirkten, sein (...) näheres Umfeld prägten und ihm wichtige Impulse für seine Orientierung vermittelten. Verbindungsstränge zwischen diesen Wirkungsströmen und vorgriechischen Kulturschichten sind in den letzten Jahren verstärkt erforscht worden. Die vorliegende Studie macht sich zur Aufgabe, die Einwirkung von Frauen - als Garanten traditionsorientierter Erfahrungswerte und Erziehungsideale - und von weiblichen Gestalten der griechischen Mythologie als Impulsgeber für Platons philosophisches Lehrgebäude auszuleuchten. Die feministische Forschung hat den Frauen im kreativen Schaffen Platons bisher lediglich Nischenplätze eingeräumt. In wichtigen Etappen für die Strukturierung von Platons Ideenwelt zeigt sich die Einflussnahme von Frauen mit hohem Bildungsniveau, wie der Philosophin Periktione, Platons Mutter, der Seherin Diotima, die Sokrates - Platons Protagonisten in vielen seiner Dialoge - zur Umstellung des philosophischen Diskurses auf die Dialogform motiviert, sowie auch von Themistokleia, der Orakelpriesterin von Delphi, deren Wirken über die Vermittlung von Pythagoras zum Tragen kommt. Diese Interaktion Platons mit weiblicher Intellektualität gilt es, im Kontext zu erschliessen und in ihrer Gesamtwirkung zu würdigen. Ohne die Aktivierung weiblicher Inspirationsquellen wäre Platons philosophisches Projekt Stückwerk geblieben. (shrink)

Nous essayons d'éclaircir quelques principes fondamentaux de la grammaire transformationelle de Chomsky à partir de Derrida et de Lacan. Nous tâchons d'approfondir deux problèmes : le premier concerne la portée de ceci que la possibilité de la déviation est donnée comme inhérente à l'institution même de la règle grammaticale; le second a trait au statut et au contenu du tiers sujet en tant que fondement de la structure intersubjective du langage. Primo : Selon Chomsky, une grammaire idéale doit être capable (...) de générer toutes les phrases — et rien que les phrases — bien formées à partir d'un nombre fini de règles. Une grammaire idéale et cohérente ne peut traiter les déviations que comme des possibilités purement accidentelles : une déviation n'aurait pas dû y être; elle n'aurait même pas pu y être. Bref, le risque d'un échec n'est pas interrogé comme prédicat essentiel de la grammaire. À en croire Derrida, on devrait regarder les conséquences qui découlent du fait qu'un risque possible est toujours possible. Comme les déviations présupposent une règle, chaque règle présuppose le risque d'un échec. La possibilité d'un échec est la condition nécessaire d'une règle grammaticale. Mais il s'agit d'une condition très spécifique, puisqu'elle rend impossible cela même qu'elle rend possible. Ni la grammaire, ni la déviation ne sont originaires, mais bien la différance entre les deux, ce qui veut dire qu'à l'origine de la production du sens il n'y a pas une grammaire idéale. Nous avons élaboré cette remarque de Derrida à partir d'une analyse de la métaphore, précisément parce que celle-ci ne peut être intégrée dans un système grammatical préalable. Secundo : la présence implicite d'un sujet compétent chez Chomsky doit expliquer pourquoi le sens ne dépend pas de l'arbitraire d'un sujet empirique. Chaque parole présuppose un Tiers, un Autre qui transcende les positions de destinateur et de destinataire. Mais, pour Chomsky, il s'agit d'un sujet idéal capable de déterminer a priori le sens invariable des lexemes auquel doivent se tenir les différents sujets. Le sujet compétent correspond à la nature universelle et rationelle de l'homme. Pour Lacan toutefois, ce Tiers — l'Autre — n'est pas un sujet universel mais bien un sujet marqué par un manque : cet Autre — sujet à manque et dès lors pas absolu — ne peut plus fixer a priori le sens d'un signifiant. Les différents effet de sens d'un signifiant ne peuvent plus être reuni dans une signification commune que l'Autre pourrait déterminer a priori. Nous démontrons comment l'intersubjectivité doit être comprise dans la perspective lacanienne. (shrink)

Ẓuhūr al-amān (The advent of security) is a book on civics published during the reign of Ammanullah Khan (1919-29) as amir of Afghanistan. The book's title pays homage to the name of Ammanullah Khan himself. In its treatment of the duties of the members of Afghan society to the ruler and to each other, Ẓuhūr al-amān appears to highlight the challenges faced by Ammanullah Khan in his efforts to modernize Afghanistan. The book is divided into more than 30 short (...) chapters describing the rights and responsibilities of the ruler, of persons living within a family unit, and of members of Afghan society as a whole. Some sections, such as one on the rights that are to be afforded to the king (ḥuquq-i lazima bar padishah), are further divided into subsections. The book begins with several chapters on religious matters, including those on tauhid (the unity of God), on ʻibada (worship), and on fahm-i sharīʻat-i rasūl ʻalayhi al-salām (the sharia). Ẓuhūr al-amān was published on October 11, 1923, by the then newly established Ministry of Education. The author of the work, a religious scholar by the name of ʻAbd al-Haqq, lists his father as ʻAbd al-ʻAziz from the village of Lower Arghanda in the township of Paghman, near Kabul. He highlights, as well, his tribal affiliation with the well-known Pushtun tribe of Suleimankhel. (shrink)

The early period Ismaili jurist Al-Qādî al-Nu'mān appears as an important figure in the formation of Ismaili jurisprudence. There is very little information about Kadı Nu'mân's family, childhood, education and intellectual environment. His full name is Abû Hanîfah Nu'man b. Muhammad b. Mansûr al-Qādî at-Tamîmî Al Qayrawānî. He was born around 290/903 (late 3rd (9th) century) into an educated family in Qayravan in North Africa. There are different opinions about the sect he belonged to when he was growing up. On (...) the other hand, it is difficult to say for certain whether Nu’mān received education in the Ismaili sect due to the understanding of taqiyya in the madhhab. However, it is understood from the basic jurisprudence texts Nu’mān wrote that he most likely did not receive a Sunni education. Historians refer to him as 'Qadi Nu’mān or Abu Hanifah al-Shi'i' in order not to confuse him with the imam of the Hanafi school. Qādî Nu’mān served at different levels of the Fatimid State. Around 313/925, he entered the service of the first Fatimid caliph, Mahdi (r. 909-934 CE/297-322 AH), as a copyist and secretary. During the reigns of the third caliph Mansur and the fourth Fatimid caliph Mu’izz (d. 365/975), Qādî Nu’mān first served as a judge in Tripoli and then in Mansouriya, the Fatimid capital. After the Fatimids conquered Egypt and the center of government was moved to Cairo, Qādî Nu’mān was appointed by the fourth caliph Mu’izz as the head of the appellate courts (maẓālim). Qadi Numans career was at the peak in the period of Caliph Muiz. Qādî Nu’mān worked as a judge in the Fatimid State for about twenty-six years and continued this duty until his death in 363 (973). After the fall of the Fatimid caliphate, there haven’t been any other Fatimid or Ismaili jurists. Qādî Nu’mān is considered by contemporary Ismaili writers as a figure who systematically transformed Ismaili fiqh into an independent sect of fiqh. It can be said that Ismaili fiqh was developed through his works in the Fatimid period. His works continued as the main references in the fiqh studies and after the Fatimid period. With the death of Qādî Nu’mān, the period of ijtihad in Ismaili fiqh and its the establishment phase of Ismaili fiqh came to an end; The sect, in which esoteric interpretations were at the forefront, emerged as a distinctive school of fiqh by discarding ambiguity. Qādî Nu’mān was a very productive writer. He wrote important works related to the field of furu al-fiqh and usûl al-fiqh. Among his works, Ikhtilāf uṣūl al-madhāhib is undoubtedly one of the most important works in the early history of fiqh methodology. The work in question, which was originally written with the aim of rejecting the Sunni fiqh method, discusses the approaches of the Sunni schools of fiqh on ikhtilāf, taqlid, ijma, nazar, qiyas, istihsan, ijtihad and ra’y in a polemical manner. It reveals the differences of the Ismaili method from the Sunni method in terms of the sources on which the fiqh is based, the authority to make ijtihad and the theory of interpretation of the texts. Qādî Nu’mān examined the relationship between reason and revelation in general and the role of religious authority in comprehending and interpreting the texts while criticizing Sunni methods. Ikhtilāf uṣūl al-madhāhib has the characteristics of the works of development period as a form. It is possible to observe the question-answer and dialectic form which can be seen in the works of the development period throughout the work in question. Qādî Nu’mān endeavoured to persuade his opponents with a dialectical and argumentative style. Again, he replied to the Sunnis, who were his interlocutors, with their own proofs. In addition to these, Ikhtilāf uṣūl al-madhāhib has a unique feature in the matter of content. Because it is not very familiar to any Sunni handbook of usûl al-fiqh. It does not mention the hâss, âmm, ijma, qiyas, amir, nahy, alfaz bets, etc. The text is very similar to the Ahbari movement of the Jafari sect for it rejects all forms of ijtihad. It was written at a time when fiqh was not yet stable. Ikhtilāf uṣūl al-madhāhib gives us crucial information about the development of different usûl and fiqh sources in the middle of the fourth century. However, what is interesting here is that the information he gives about Ismaili method and fiqh is very little compared to the one about Sunni method and fiqh. Much of it centered on Sunni thought and its rejection. However, his ultimate goal was to defend the Ismaili doctrine. (shrink)

Religious songs have an important place in Turkish Classical Music in terms of maqam, usul, form, composers, and songwriters. The main purpose of this study is to examine the religious songs in Segâh Maqam in the TRT Turkish Classical Music Repertoire in terms of form, usul, composers, and songwriters. The data of the research were obtained through literature and document review. In this context, the musical notes of religious songs in Segâh Maqam were analyzed through content analysis. As a result (...) of the reviews of TRT Turkish Classical Music Repertoire, a total of 107 religious songs in Segâh Maqam has been identified. In the form analyses of the identified religious songs, it was found that İlâhi, Durak, and Teşvih forms were used frequently; in the usul analyses, it was found that Sofyan, Düyek, Devr-i Hindî, Durak Evferi, Yürük Semaî and Nim Sofyan usuls are used frequently; in the composer analyses, it was found that Bekir Sıtkı Sezgin, Güldeniz Ekmen, Amir Ateş,, Hüseyin Sâdettin Arel, Erdinç Çelikkol Zeki Altun, Faruk Şahin, Halil İbrâhim Taşkent, Hüseyin Sebilci, Mehmet Tulûî, Sadettin Kaynak, Süleyman Erguner, and Ümit Gürelman have more religious songs compared to other identified composers; in the songwriter analyses, it was found that Yûnûs Emre, Niyâzî-i Mısrî, Eşrefoğlu Rûmî, Hamdi Özer, İbrâhim Hakkı, Sezâî, and Yûnûs have more songs compared to other identified songwriters. Die Kommunikation in der Wissenschaft wird grundsätzlich als Kommunikation unter den Kolloquien eines bestimmten Wissenschaftsbereichs hergestellt. Wissenschaftliche Zeitschriften, Konferenzen usw. fußen auf diesem Prinzip. Beispielsweise setzt die Vorstellung vom Peer-Reviewer einen solchen kollegialen, monodisziplinären Rahmen voraus. Jedoch nötigen uns multidisziplinäre Forschungen und Engagement um praktische Angelegenheiten, die Situation in neuem Licht zu besehen. Was für eine Bedeutung kann multidisziplinäre Diskussion haben? Wie lässt sich eine solche multidisziplinäre Diskussion aufbauen? Ist eine solche Diskussion bloß ein Tauziehen zwischen den unverträglichen Ansichten (...) – ein Krieg der Wissenschaften? In einem ordentlichen Dialog sollte die Praxis der endgültige Arbiter sein, nicht die wissenschaftliche Theorie. (shrink)

Résumé — L’Encyclopédie hégélienne n’indique pas ce que devrait être une philosophie systématique, mais rend ce système effectif. Et, pourtant, sa présentation rigoureuse, sous forme de paragraphes, accepte le voisinage intermittent et désordonné d’un certain nombre de remarques, munies du laissez-passer tout relatif que leur offre leur brièveté, et récusant souvent par leur longueur cette justification même. On tente d’abord ici de saisir l’origine des remarques, en s’intéressant aux différents voisinages du système encyclopédique : la parole philosophique et populaire, le (...) parcours phénoménologique, les explications préliminaires, les esquisses d’encyclopédie non publiées et l’énigmatique « encyclopédie autre, habituelle » à laquelle se réfère régulièrement Hegel. Le désordre des remarques s’explique alors par la rencontre entre différents ordres .On en déduit finalement qu’il y a place chez Hegel pour une logique de la non-rigueur, qui fonde l’invention des remarques, en acceptant toutes les rencontres. Cette logique révèle, selon ses propres termes, les parentés et les divergences entre les connaissances non philosophiques et la pensée pure ; elle assure la brièveté et la complétude de l’exposition. Bref, elle réalise toutes les exigences d’une encyclopédie philosophique, elle la fait être.Die hegelianische Enzyklopädie weist nicht darauf hin, wie eine systematische Philosophie beschaffen sein sollte, sondern sie verwirklicht dieses System selbst. Ihre strenge Darstellung, organisiert inParagraphen, lässt das zeitweilig unterbrochene und ungeordnete Nebeneinander zahlreicher Anmerkungen zu. Deren Kürze verleiht ihnen auf befremdliche Art einen Freibrief, eine Rechtfertigung, die jedoch durch die Länge einiger Anmerkungen zurückgewiesen wird. Der vorliegende Artikel versucht zunächst, den Ursprung dieser Anmerkungen zu erfassen, indem er sich den verschiedenen Nebenbereichen des enzyklopädischen Systems zuwendet : der philosophischen und der populären Rede, dem phänomenologischen Verlauf,den vorläufigen Erklärungen, den unveröffentlichten Entwürfen der Enzyklopädie und schliesslich der rätselhaften « anderen, gewöhnlichen Encyclopädie », auf die sich Hegel regelmässig bezieht. Im Lichte dieser Beziehungen erklärt sich die Unordnung der Anmerkungen alsdann als das Ergebnis eines Zusammentreffens unterschiedlicher Ordnungen .Aus diesen Untersuchungen ergibt sich die Feststellung, dass Hegel einen Platz einräumt für eine Logik der Nicht-Strenge, die die Erfindung der Anmerkungen begründet, indem sie ein jegliches Zusammentreffen zulässt. Diese Logik enthüllt, nach ihren eigenen Worten, die Verwandtschaften und Abweichungen zwischen den nicht-philosophischen Kenntnissen und dem reinen Denken ; sie sichert die Kürze und die Vollkommenheit der Ausführungen. Kurz gesagt, sie erfüllt alle Anforderungen einer philosophischen Enzyklopädie, sie verwirklicht ihr Sein. (shrink)
